1. Acceptance of Terms

By accessing or using the StretchWise Academy website, online courses, workshops, learning materials, or any related services, you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

You must be at least 18 years of age to register for our programs or submit personal information through our website. By using our services, you represent and warrant that you meet this age requirement.

2. Description of Services

StretchWise Academy AS is a Norwegian-registered educational entity providing online stretching, flexibility, and mobility education programs to individuals throughout Canada. Our services include:

• Structured online courses covering stretching fundamentals, flexibility development, and mobility awareness
• Educational workshops and guided learning sessions delivered remotely
• Downloadable learning resources, guides, worksheets, and practice materials
• Access to recorded learning modules and live educational sessions
• Progress tracking tools and participant learning dashboards
• Educational support and communication with specialists

All programs are designed exclusively for educational purposes. StretchWise Academy does not provide medical advice, therapeutic treatment, or personalized health interventions.

3. User Obligations and Acceptable Use

You agree to use our services lawfully and in accordance with these Terms. Prohibited activities include, but are not limited to:

• Violating any applicable laws or regulations in Norway, Canada, or your jurisdiction
• Reproducing, distributing, or sharing course materials without written authorization from StretchWise Academy
• Using automated tools, bots, or scrapers to access or extract content from our website
• Impersonating another person or entity, including academy staff or specialists
• Uploading or transmitting viruses, malware, or any harmful code
• Attempting to gain unauthorized access to our systems, servers, or databases
• Harassing, threatening, or abusing other participants, specialists, or staff
• Using our platform to promote unrelated products, services, or third-party commercial activities
• Engaging in any activity that disrupts or interferes with the proper functioning of our services

StretchWise Academy reserves the right to suspend or terminate your access immediately if you violate these obligations.

4. Intellectual Property Rights

All content available through StretchWise Academy, including but not limited to text, graphics, videos, course materials, logos, audio recordings, software, and design elements, is the exclusive property of StretchWise Academy AS or its content licensors.

Our content is protected by copyright, trademark, and other intellectual property laws in Norway, Canada, and internationally. Unauthorized reproduction, modification, distribution, public display, or creation of derivative works is strictly prohibited.

Upon enrollment in a program, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the educational materials solely for personal, non-commercial learning purposes. This license terminates immediately upon violation of these Terms or upon completion or cancellation of your program enrollment.

You may not sell, license, rent, or otherwise commercialize any materials obtained from StretchWise Academy.

5. Disclaimers and Limitation of Warranties

StretchWise Academy provides educational content and services on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding:

• The accuracy, completeness, or reliability of any educational content
• The availability or uninterrupted operation of our website or services
• The suitability of our programs for your individual needs, goals, or circumstances
• The achievement of specific physical, wellness, or personal outcomes
• The prevention of injury or health complications

To the maximum extent permitted by applicable law, StretchWise Academy disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our educational programs are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider before beginning any stretching, flexibility, or mobility program, especially if you have pre-existing health conditions, injuries, or concerns.

6. Limitation of Liability

To the fullest extent permitted by Norwegian and Canadian law, StretchWise Academy AS, its directors, employees, contractors, specialists, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

• Your use of or inability to use our website or services
• Any injury, discomfort, or adverse physical outcome resulting from participation in our programs
• Errors, inaccuracies, or omissions in educational content
• Service interruptions, technical failures, or loss of data
• Unauthorized access to your account or personal information
• Third-party conduct or content accessed through our platform

In no event shall StretchWise Academy's total liability to you exceed the amount you paid for the specific program or service giving rise to the claim, or 500 Norwegian kroner, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability shall be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless StretchWise Academy AS, its officers, directors, employees, specialists, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms of Use
• Your misuse of our services or educational materials
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any injury, harm, or damage you incur during or after participation in our programs
• Any false, misleading, or inaccurate information you provide to us

This indemnification obligation survives termination of your relationship with StretchWise Academy.

8. Third-Party Links and External Content

Our website may contain links to third-party websites, services, or resources for informational or educational purposes. StretchWise Academy does not control, endorse, or assume responsibility for any third-party content, products, services, or privacy practices.

Your interactions with third-party websites are governed by their respective terms and privacy policies. We strongly encourage you to review those policies before providing any personal information or engaging with external platforms.

StretchWise Academy is not liable for any loss, damage, or dispute arising from your use of third-party websites or services accessed through our platform.

9. Privacy and Data Protection

Your use of StretchWise Academy services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

By using our services, you consent to the data practices described in the Privacy Policy. We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Norwegian and Canadian privacy laws.

10. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law principles.

StretchWise Academy AS is a legal entity registered in Norway with its principal place of business at Bakkegata 18, 5750 Odda, Norway.

Any disputes arising from or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Odda, Norway, or the nearest competent court with jurisdiction over the matter.

11. Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt informal resolution by contacting StretchWise Academy directly at [email protected]. We will make reasonable efforts to resolve the matter through good-faith negotiation within 30 days of receiving your notice.

If informal resolution is unsuccessful, the dispute shall be submitted to binding arbitration in Odda, Norway, in accordance with the Norwegian Arbitration Act, or resolved through the competent courts of Norway as specified in Section 10.

12. Termination of Access

StretchWise Academy reserves the right to suspend, restrict, or terminate your access to our website and services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Use
• Fraudulent, abusive, or illegal activity
• Failure to pay applicable fees for enrolled programs
• Conduct that harms or may harm other participants, specialists, or the academy's reputation
• Prolonged inactivity or abandonment of an enrolled program

Upon termination, your right to access course materials, recorded sessions, and learning resources will cease immediately. StretchWise Academy is not obligated to provide refunds for partially completed programs if termination results from your violation of these Terms.

Sections of these Terms that by their nature should survive termination, including intellectual property provisions, disclaimers, limitation of liability, and indemnification, shall remain in effect after termination.

13. Changes to These Terms

StretchWise Academy reserves the right to modify, update, or replace these Terms of Use at any time. Material changes will be communicated through a prominent notice on our homepage or via email to registered participants at least 14 days before the changes take effect.

Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of our platform and may contact us to request account closure.

We encourage you to review these Terms periodically to stay informed of any updates. The "Last Updated" date at the top of this page indicates when the most recent changes were made.

14. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable by a court or other competent authority, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy and any program-specific enrollment agreements, constitute the entire agreement between you and StretchWise Academy regarding the use of our services. These Terms supersede any prior agreements, representations, or understandings, whether written or oral.

16. No Waiver

The failure of StretchWise Academy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of a breach of these Terms shall not be deemed a waiver of any subsequent breach.

17. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations under these Terms without the prior written consent of StretchWise Academy. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
